
Legal Disclaimer & Liability Waiver Agreement
For Training Services Provided by K9 Excellence Academy
This Legal Disclaimer and Liability Waiver (“Agreement”) is entered into by and between K9 Excellence Academy, a professional dog training service (“Trainer”), and the undersigned dog owner (“Client” or “Owner”), collectively referred to as the “Parties.”
By enrolling in any training session, program, consultation, or service provided by Trainer, the Client acknowledges and agrees to the following terms and conditions in full:
1. Assumption of Risk & Waiver of Liability
Client acknowledges and understands that participation in dog training involves both known and unanticipated risks which could result in physical injury to themselves, their dog(s), other animals, or third parties, as well as property damage. These risks may arise from the dog’s behavior, the behavior of other dogs, environmental hazards, or the inherent unpredictability of animal behavior.
Client voluntarily assumes all risks associated with participation in training services and agrees that Trainer, including its owners, employees, contractors, affiliates, and representatives, shall not be held liable for any injuries, losses, claims, or damages whatsoever, to any person, animal, or property that may occur during, or as a result of, training sessions. This includes, but is not limited to, bites, scratches, injuries from slipping or falling, and damages caused by behavioral issues.
2. Responsibility for Dog’s Behavior and Training Maintenance
Client agrees and understands that dog training is not a “quick fix” or a guaranteed solution. Successful training requires a long-term commitment and consistent effort on the part of the Owner. While the Trainer provides professional guidance, tools, techniques, and customized instruction, it is the Owner’s responsibility to apply these methods on a continuous basis.
Trainer makes no guarantees, express or implied, about the dog’s behavior following completion of training. The Client is solely responsible for reinforcing training at home, practicing techniques, using provided training tools correctly, and maintaining consistent boundaries and structure. Failure to do so may result in a regression of learned behaviors or exacerbation of behavioral issues, for which Trainer accepts no responsibility.
3. Acknowledgment of No Guarantees
Client acknowledges that every animal is an individual with its own temperament, history, and learning capacity. While Trainer uses proven techniques rooted in behavioral science, results may vary based on a variety of factors including but not limited to the age, breed, health, and prior experiences of the dog.
Client understands that dog behavior is influenced by ongoing social, environmental, and familial factors beyond the Trainer’s control. Therefore, Trainer makes no warranties or guarantees, express or implied, regarding the effectiveness or longevity of training results.
4. Health, Vaccinations, and Behavioral Disclosures
Client certifies that their dog is in good general health and is free from any condition that may impact its ability to participate in training. Client affirms that their dog is up-to-date on all core vaccinations, including rabies, distemper, parvovirus, and any other vaccines required by local law or reasonably recommended by veterinary professionals.
Client agrees to disclose all known behavioral issues prior to the start of training, including aggression, resource guarding, reactivity, fear-based behaviors, or previous history of biting or attacking people or animals. Failure to fully disclose such information may result in immediate termination of services, with no refund issued.
5. Off-Leash and Advanced Behavior Training
Where off-leash training, recall, or advanced behavior modification is conducted, Client acknowledges the increased risk associated with removing physical restraints or addressing severe behavior issues. Although Trainer will exercise due care and professional expertise, such training inherently carries risks of escape, injury, and unpredictability.
By choosing to engage in such services, Client voluntarily assumes full responsibility for the safety and actions of their dog while off-leash and thereafter, and agrees to indemnify and hold harmless the Trainer from any resulting incident, claim, injury, or loss.
6. Indemnification
Client agrees to indemnify, defend, and hold harmless K9 Excellence, its owners, employees, contractors, volunteers, agents, and representatives from and against any and all claims, losses, liabilities, damages, costs, expenses (including reasonable attorney’s fees), or demands arising out of or relating to:

The actions or behavior of their dog during or after training;

Injuries to any person, animal, or property caused by their dog;

Misuse or improper application of training tools or techniques;

Failure to maintain consistent reinforcement of the training after the program ends.
7. Photo/Video Release (Optional)
Client consents to the use of photos and videos of their dog taken during training sessions for promotional, educational, or marketing purposes by K9 Excellence Academy. No personal identifying information will be disclosed without prior written consent.
8. Governing Law and Severability
This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
